1. Acceptance of Terms

By accessing and using Make AI Video's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

Make AI Video provides AI-powered video generation services that transform static images into dynamic videos. Our service includes:

• AI video generation from uploaded images
• Various video styles and effects
• Download and sharing capabilities
• User account management
• Technical support and assistance

3. User Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree to use our service only for lawful purposes and in accordance with these terms.

4.1 Prohibited content

You must not upload, generate, or attempt to generate content that:

• Is sexually explicit, pornographic, or depicts nudity or sexual acts
• Sexualises, endangers, or otherwise exploits minors in any way. We report suspected child sexual abuse material to the relevant authorities
• Depicts a real, identifiable person without their consent — including face swaps, deepfakes, and using someone's photo to place them in a scene they did not take part in
• Harasses, bullies, threatens, humiliates, or degrades any person or group
• Promotes or depicts graphic violence, gore, self-harm, terrorism, or cruelty to animals
• Incites hatred or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Impersonates another person, brand, or organisation
• Infringes anyone's intellectual property, privacy, or publicity rights
• Is otherwise unlawful in your jurisdiction or ours

4.2 Prohibited conduct

• Attempting to reverse engineer, scrape, or resell the service
• Creating multiple accounts to obtain additional free credits, or otherwise circumventing usage limits
• Interfering with the security or integrity of our platform
• Attempting to bypass our content filters, including by obfuscating prompts

4.3 How we enforce this

We screen prompts automatically before generation. Requests that match our prohibited-content rules are refused and are not sent to our model providers. Where a request clearly and unambiguously breaches section 4.1, the account is suspended automatically. Finished videos are also checked before they are delivered; a video that fails that check is withheld and its credits returned. The full details are in our Acceptable Use Policy.

When you upload a file, you confirm that you have the right to use it and that anyone recognisable in it has agreed. Anyone can report content that breaks these rules at makeaivideo.net/report.

We reserve the right, without prior notice, to refuse any request, remove or disable access to any content, suspend or terminate any account, and report unlawful activity to the appropriate authorities.

If we suspend or terminate a paid account under this section, we refund what you have paid us. We do this on our own initiative — you do not have to ask. We may refund either the full amount or the unused portion at our discretion; our standard practice is to refund in full, including credit packs that would not otherwise be refundable under section 6.

A refund does not reinstate the account, and it does not limit our ability to keep records of the activity or to report it where the law requires us to.

If you believe your account was suspended in error, contact us and we will review it. Automated filters are imperfect and we would rather fix a wrong call than leave it standing.

4A. Your Responsibility and Indemnity

You are solely responsible for the prompts you submit, the images and videos you upload, and the content you generate. You confirm that you have the rights to any material you upload, and consent from any identifiable person appearing in it.

You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the service, the content you upload or generate, your breach of these terms, or your violation of any third party's rights.

5. Content Ownership

You retain ownership of the content you upload and the videos and images you generate. You grant us a limited license to process your content for service delivery.

5.1 Commercial use

Whether you may use an output commercially depends on the plan your account was on when that output was generated:

• Generated on a paid plan (Starter, Pro or Studio): you may use it for any lawful purpose, including commercial use. That right stays with the output after your plan ends.
• Generated on the free tier: personal, non-commercial use only, and the watermark must stay on. Upgrading later does not change this for outputs you have already made; generate them again on your plan instead.
• Generated while you had purchased credits left from a one-time purchase (see section 6.1): same as a paid plan, including commercial use, and that right stays with the output after those credits run out. A legacy Starter Pack purchase remains an exception: outputs made with those credits count as free tier.

Commercial use never overrides the rest of these terms: you are still responsible for what your output shows, including other people's likeness, trademarks and music you did not write.

6. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis. You agree to pay all charges incurred in connection with your account. We reserve the right to modify pricing with 30 days notice.

Who processes your payment. Orders are processed by Waffo Pancake (Waffo.com Limited), which acts as the merchant of record: it sells the order to you, handles payment and sales tax, and its name may appear on your card statement (for example “WAFFO” or “WAFFO PANCAKE”) instead of ours.

Questions about a charge. You can see your orders, download invoices, manage a subscription or report a problem with a payment in the billing portal (sign in with the email you paid with), or email us at support@makeaivideo.net. Please contact us before disputing a charge with your bank; we can usually fix it faster.

6.1 How credits work

• Plan credits come with a paid plan each month (annual plans also receive them monthly). Unused plan credits roll over to the next month for as long as your plan is active, and expire when your plan ends.
• Free credits are the ones you get for signing up and for daily check-ins. They expire 30 days after the last time you earned free credits; every check-in resets that clock. They have no cash value.
• Purchased credits from a one-time purchase never expire. Anyone can buy them, no subscription needed. While you have purchased credits left, your account gets everything a plan unlocks: watermark-free exports, 1080p and every model. When they run out, your account goes back to the free tier unless you also have a plan.
• Legacy Starter Pack purchases ($1.99 for 40 credits) remain an exception: they only add credits. Those accounts stay on the free tier, so exports keep the watermark and paid-only models stay locked. This product is no longer offered for sale.

Free credits or promotional credit allowances may be unavailable in some regions because of payment provider or compliance restrictions. This does not affect your ability to purchase paid credits or plans where payment is otherwise available.

When you generate, we use free credits first (they expire soonest), then plan credits, and purchased credits last. If your plan is ending before your free credits expire, we use plan credits first. Your credits panel shows them in that order.

6.2 Refunds

Refund window. You can request a refund within 10 days of a purchase (a plan payment or a one-time purchase), as long as your account still has unused credits from it. The refund is proportional to the credits from that purchase you have not used. After 10 days, purchases are not refundable. Historical Starter Pack purchases ($1.99) are not refundable.

Subscriptions. You can cancel at any time. Cancelling stops the next renewal; your plan keeps running until the end of the period you paid for.

One-time purchases. Credits from a one-time purchase never expire.

If we suspend your account. Whatever the reason, we refund everything you have paid us, on our own initiative and without you having to ask. This covers subscriptions and credit packs alike. See section 4.3.

7. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may temporarily suspend service for maintenance or updates.

8. Intellectual Property

Our platform, technology, and content are protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without permission.

9. Limitation of Liability

Make AI Video is not liable for any indirect, incidental, or consequential damages arising from your use of our service. Our total liability is limited to the amount you paid for the service.

10. Termination

You may cancel your account at any time. We may terminate your access for violations of these terms. Upon termination, your right to use the service ceases immediately.

If the account we terminate is a paid one, we refund what you have paid — see sections 4.3 and 6.2. If you think we got it wrong, email support@makeaivideo.net and we will review it. Our filters are automated and imperfect; we would rather reverse a wrong call than defend it.

11. Changes to Terms

We may update these terms from time to time. Continued use of our service after changes constitutes acceptance of the new terms.

12. Governing Law

Make AI Video is operated by an individual, not an incorporated company. These terms are governed by the laws of the operator's place of residence, and any dispute will be resolved in the courts having jurisdiction there.

Nothing in these terms removes any consumer protection right you have under the mandatory laws of the country you live in. If you are a consumer in the EU or UK, you may also bring proceedings in your own country's courts.
